Countdown to Deadline for Daniel to File his Appeal

In 2022 Daniel, 10 years old at the time and a 5th grade honor roll student without any history of behavioral issues, was arrested in his Florida home, publicly vilified, incarcerated for two weeks, and subsequently sentenced to punitive parole conditions—all for sending a private text message to his friend that was clearly intended as a joke. 


Because he is a child, Daniel is not eligible for a jury trial.  Please join us in support of common sense law enforcement, due process, and freedom of speech.

Kids make mistakes and it is our job to teach and discipline them—not to let elected officials demonize them or destroy their future for saying something inappropriate or offensive in a private conversation.

Prosecutor in Daniel Marquez school threat case tries to punish father for TikTok video

Lee County Judge Carolyn Swift didn’t say how long Marquez would be on probation, but the conditions include a 6 p.m. to 6 a.m. curfew, a diversion class, an appearance before a neighborhood accountability board, and a 500-word essay defining a school threat and what he has learned from this case so far.
